Terms of Service
Last updated 15 October 2026
These terms apply when you use the AlcoMart website or app, as a customer, a delivery rider or a liquor store. By creating an account or placing an order you agree to them. Please also read our Privacy Policy.
1. Who can use AlcoMart
- You must be 18 or older. We ask for your date of birth, and riders may ask to see ID on delivery.
- A rider will not hand over an order to anyone who appears under 18, can't show valid ID when asked, or appears drunk. The order is then returned and treated as a failed delivery (see section 4).
- Alcohol bought through AlcoMart is for personal use, not resale.
2. How AlcoMart works
AlcoMart is a marketplace:
- the drinks are sold by independent licensed liquor stores;
- orders are delivered by independent riders;
- AlcoMart provides the platform, takes payment on the store's behalf and charges a service fee and a delivery fee.
Each store is responsible for the drinks it sells: their quality, legality and accurate descriptions.
3. Orders, prices and payment
- Prices are set by each store and include VAT where applicable. Service and delivery fees are shown before you pay.
- You pay with M-Pesa. Your order is confirmed once payment succeeds.
- A store may decline an order, for example if an item is out of stock. If the store doesn't accept your order within the time shown, it is cancelled automatically.
- If an item is out of stock, the store may suggest a replacement. You can accept it (you never pay more than the original item) or decline it (the item is removed and refunded).
- Promo codes have their own conditions, shown when you use them, and can't be exchanged for cash.
4. Refunds
- You get a full refund if your order is cancelled before it is collected: by you, the store or AlcoMart, or because nobody accepted it in time.
- Removed or cheaper replacement items are refunded for the difference.
- Refunds go back to the M-Pesa number you paid with, normally within one business day.
- If delivery fails because you weren't available, couldn't show ID or appeared under age or drunk, the delivery and service fees are not refunded.
- For problems with a delivered order, use “Report a problem” on the order within 24 hours.
5. Delivery
- Delivery times are estimates.
- Deliveries only happen when the store is open and within the hours its licence allows.
- Please be at the address you chose. Your rider may call you, and will give you the order once you share your delivery code.
6. Riders
- Riders are independent and choose when to go online and which orders to accept.
- Riders must keep their documents valid and true, follow traffic laws, use the pickup and delivery codes, and refuse delivery to anyone under 18 or drunk.
- Location is shared while a rider is online so customers can follow their order.
- Earnings are paid to the rider's M-Pesa number as shown in the app.
7. Stores
- Stores must hold a valid liquor licence and business permit and keep them current.
- Stores must list accurate prices and stock, accept or decline orders promptly, hand orders only to the rider who gives the correct pickup code, and issue receipts as Kenyan tax law requires.
- The AlcoMart till (POS) is free to use. Stores are responsible for their own counter sales and tax.
8. Things you must not do
- Give false details, use someone else's account, or let anyone under 18 use yours.
- Misuse promo codes, place fake orders, or abuse riders, stores or staff.
- Try to break, copy or overload the service.
We may suspend or close accounts that break these terms.
9. Responsibility
We work to keep AlcoMart available and accurate, but the service is provided “as is”. As far as the law allows, AlcoMart is not responsible for losses caused by stores or riders, or by events outside our control. Our total liability for any order is limited to what you paid for it. Nothing in these terms limits your rights under the Consumer Protection Act, 2012.
10. Closing your account
You can delete your account at any time from your profile in the app (see how to delete your account).
11. Changes and law
We may update these terms. If changes are important, we'll tell you in the app. These terms are governed by the laws of Kenya, and disputes go to the courts of Kenya.
